Understanding the POSH Act, 2013 & Employer Obligations

A plain-language legal guide for factory owners, HR heads, hospital administrators, and compliance officers across Tiruppur and Tamil Nadu.

What is the POSH Act, 2013?

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (Act No. 14 of 2013, notified by the Ministry of Women and Child Development, Government of India on 9 December 2013) is a mandatory central law enacted to protect women’s constitutional right to equality and dignity at work (Articles 14, 15, and 21), codifying the Supreme Court’s landmark Vishaka v. State of Rajasthan guidelines.

Mandatory for 10+ Employees

Every workplace, garment factory, spinning mill, dyeing unit, hospital, hotel, retail showroom, or office employing 10 or more employees (whether permanent, temporary, contractual, daily-wage, apprentice, or agency workers) is legally bound to comply.

Who It Protects & Scope

Protects all women working at or visiting a workplace against unwelcome physical contact, sexual advances, sexually coloured remarks, quid pro quo demands, or a hostile work environment — including during employer-provided transport and field visits.

Internal Committee (IC) Statutory Requirements (Section 4)

Under Section 4 of the POSH Act 2013, every employer must constitute anInternal Committee (IC) by written order at each branch or factory unit:

  • Presiding Officer: Must be a woman employed at a senior level at the workplace.
  • Internal Members: Not less than 2 employees committed to the cause of women or having legal/social work knowledge.
  • Mandatory External NGO Member (Section 4(2)(c)): 1 independent member from an NGO or association committed to the cause of women — fulfilled by Sahayithi Foundation.

Statutory & Audit FAQs

Frequently Asked Questions on POSH Act 2013 Compliance

Clear answers on Internal Committee constitution, External NGO Member empanelment, Tamil floor training, and buyer social audits in Tiruppur.

Which organisations in Tiruppur and Tamil Nadu are legally mandated to comply with the POSH Act, 2013?

Under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, every company, garment factory, spinning mill, hospital, hotel, retail outlet, or branch office employing 10 or more persons (whether permanent, temporary, contractual, or interns) is legally mandated to constitute an Internal Committee (IC) and implement a compliant POSH policy.

Why does our Internal Committee (IC) require an External Member from an NGO like Sahayithi Foundation?

Section 4(2)(c) of the POSH Act 2013 strictly requires every Internal Committee to include one External Member from a non-governmental organisation or association committed to the cause of women or familiar with issues relating to sexual harassment. An IC without an independent External Member is legally invalid and fails buyer social audits (WRAP, SEDEX, BSCI, SA8000).

What are the legal penalties for non-compliance with the POSH Act 2013?

Failure to constitute an Internal Committee, conduct mandatory employee awareness training, or file the Annual POSH Report attracts a statutory fine of up to ₹50,000 for the first offence. Repeat non-compliance can result in double penalties, cancellation or non-renewal of business/factory licenses, and disqualification from international export buyer audits.

Are Sahayithi Foundation's POSH training workshops conducted in Tamil for factory floor workers?

Yes. All our employee sensitization workshops and Internal Committee capacity-building sessions are delivered in both fluent Tamil and English. We tailor floor-level sessions specifically for textile, spinning, garment, healthcare, and hospitality workforces in Tiruppur.

What documents and compliance certificates do we receive after completing a POSH training session?

Partner companies receive an official POSH Compliance & Training Certificate issued by Sahayithi Foundation (Reg No: BK-4/45/2026), attendance documentation for buyer and labour audits, an External IC Member Appointment Letter, a customised bilingual POSH Policy Charter, and support with Annual District Officer report filing.

How is an Internal Committee (IC) structured under the POSH Act 2013?

A legally compliant IC must have a senior woman employee as the Presiding Officer, at least two employee members committed to women's welfare or possessing legal knowledge, and one independent External NGO Member. At least 50% of the total IC members must be women.

What is the timeline for filing and resolving a workplace harassment complaint under the POSH Act?

An aggrieved woman can file a written complaint within 3 months of the incident (extendable by another 3 months by the IC). The Internal Committee must complete its inquiry within 90 days and submit its final report and recommendations to the employer within 10 days of completing the inquiry.
